The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406 and 420/34 of the Indian Penal Code.

It is alleged that the informant, Surendra Kumar entered into an agreement with Alka Raj alias Beauti Kumari for purchase of land. Subsequently, on payment of Sixty One lakh

Patna High Court Cr.Misc. No.68936 of 2018(2) dt.17-12-2018 2/3 rupees part of the land was registered. It is further alleged that remaining part of the land was not registered and Alka Raj started avoiding the informant. The informant came to know subsequently that the part of the land did not belong to Alka Raj. It is alleged against the petitioners that they conspired with Alka Raj.

It is submitted by learned counsel for the petitioners that there was no agreement between the petitioner and the informant and the petitioners have no concern with the said land. A statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent. Learned APP submits that the petitioners are named in the First Information Report.

Considering the fact that the petitioners are not the contracting party, coupled with the statement made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at
