The petitioner is apprehending his arrest in connection with Warisaliganj P.S.Case No.301 of 2016 registered for offences punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2016.
It is submitted on behalf of the petitioner that the petitioner has clean antecedent.
Heard learned A.P.P. also.
Having heard both sides. In view of Section 76 (2) of the Bihar Prohibition and Excise Act, 2016, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks and make prayer for regular bail, which will
Patna High Court Cr.Misc. No.9898 of 2017 (2) dt.06-03-2017 2/2 be considered by the learned court below without being prejudiced by the order of this Court.
With the aforesaid observation, this application is disposed of.
