JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2019 Learned counsel for the petitioners submits that the tenant is not making payment in terms of condition dated 6.4.2018 and he is continuing in the premises on the strength of condition laid down by this Court. Informant is not making payment. In the peculiar facts of this case liberty shall be available to the petitioner to take step in accordance with provisions of Bihar Rent (Lease, Eviction and Control) Act for eviction of the premises and recovery of the rent which is not paid by the informant and rent controller shall be under the obligation to decide the dispute in terms of provisions of Bihar Rent (Lease, Eviction and Control) Act.
