In this case, the petitioner is challenging the order dated 19.06.2013 passed by the Sub-Divisional Officer, Biharsharif, whereby and whereunder, the license of the fair price shop of the petitioner bearing License No. 11/Bihar/07 has been cancelled. It appears that a proceeding was initiated by the SubDivisional Officer, Biharsharif on account of certain irregularities found while running the P.D.S. Shop. The petitioner filed show-cause and, after considering the same, the Licensing Officer has cancelled the license of the petitioner.
Patna High Court CWJC No.15106 of 2015 dt.26-04-2017 Learned counsel for the petitioner submits that the enquiry has not been conducted in a proper manner.
As there is a Forum of appeal under the E.C. Act, let the petitioner should exhaust that remedy as is available in law. With the aforementioned observation, this application is disposed of.
