The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 341, 342, 323, 324, 325, 354, 307, 379, 458, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has antecedent of two cases and the informant alleges that accused persons, including the petitioner, came to his house and assaulted the informant by Khukari causing injury on his head and cheek and thereafter the accused persons also assaulted his family members and even one of the accused persons trying to fire but the shot misfired and the accused also
Patna High Court CR. MISC. No.22248 of 2022(3) dt.14-12-2022 2/3 took cash and chain, as detailed in the FIR.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that though it is alleged that informant was assaulted by Khukari on head and cheek, but then from perusal of the injury report it would manifest that the injuries are simple, but no doubt one of the injuries is on forehead but then the said injury is not an incised wound rather is swelling which belies the allegation of assault by Khukari.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner, but very fairly submits that the injuries are simple and the wound is not incised after perusing the case diary.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mohiuddin Nagar P.S. Case No. 238 of 2021 subject to the conditions as laid down

One of the bailors shall be the uncle of the petitioner Dilip Kumar Roy @ Dilip Ku. Roy.
