JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-05-2019 This is an application for grant of anticipatory bail in connection with Buddha Colony P.S. Case No. 67 of 2019, Spl. Case no. 1987 of 2019, disclosing offences under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act 2016.
Allegation is of recovery of 6 liters of liquor from a wood taal and the petitioner is made accused in this case. Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and nothing has been recovered from his house or from his conscious possession. Though, he is accused in one more case, but that not of the similar type.
Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Spl. Court Excise, Patna, in connection with Buddha Colony P.S. Case No. 67 of 2019, Spl. Case no. 1987 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
