JUSTICE ARUN KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Muffassil P.S. case No. 181 of 2016 instituted under Sections 366(A)/34 of the Indian Penal Code and Section 47(a) of the Excise Act.

The allegation, in brief, is that the petitioner enticed away the daughter of the informant. It is submitted that the girl was recovered next day and in her statement under Section 164 of Cr.P.C has not named the petitioner and she is major as per medical report.

Considering the aforesaid facts and circumstances of the case, let the petitioner, namely, Gulam Rabbani in the event

Patna High Court Cr.Misc. No.5717 of 2017 (2) dt.07-02-2017 of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Katihar in connection with Muffasil P.S. case No. 181 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
