JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-03-2017 This is an application for grant of anticipatory bail for offences punishable under Section 498A of the Indian Penal Code.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that he is ready to keep opposite party no. 2. As a matter of fact, opposite party no. 2 was wife of petitioner's elder brother, who had died, and, as such, her marriage was solemnized with the petitioner. Thereafter, demand of motorcycle and she-buffalo was made and due to non-fulfilment of such demand, dispute arose between the parties.

No.8783 of 2017 (2) dt.02-03-2017 2/2 Having heard both sides, in view of the submission made, let petitioner surrender in the court below, i.e., S.D.J.M., Gopalganj, in connection with Complaint Case no. 2186 of 2015 (Tr. No. 4151 of 2016) and file a petition to the effect that he is ready to keep opposite party no. 2 with him and on such surrender with filing such petition, learned court below shall release petitioner on provisional bail to its own satisfaction and issue notice to the complainant (opposite party no. 2). After appearance of the complainant, mediation between the parties shall be made and as per result of the mediation the court below will pass an appropriate order either on confirmation of bail bond or any other order what the court below deems fit and proper.
