The petitioner seeks bail in a case registered under Sections 341, 323, 385, 392, 504, 506/34 of the Indian Penal Code.

Allegation is that the accused persons on the point of pistol snatched the motorcycle and mobile of the informant and fled away.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.1.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The looted motorcycle in question is alleged

Patna High Court CR. MISC. No.20410 of 2019(2) dt.22-04-2019 2/2 to have been recovered from the petitioner. The petitioner has not been put on T.I.P. to ascertain his participation in the alleged occurrence. At best, it is a case for an offence under Section 414 of I.P.C.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Bathnaha P.S. case No.287 of 2018.
