The petitioner is in judicial custody in connection with Sonpur P.S. Case No. 605 of 2020 registered under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act lodged on 16.08.2020 by the informant Mahesh Kumar.

The aforesaid case came to be registered on the allegation made by the informant that he got information that some unknown persons have shot at his son near the temple. Upon reaching there, he was informed that the injured has been shifted to Sadar Hospital, Chapra and when he reached the said hospital, got the knowledge that his son has died. Earlier the case was taken up and vide an order dated 03.08.2022 was rejected in Cr. Misc. No. 19960 of 2022. In this case, report was called for which has since

Patna High Court CR. MISC. No.23421 of 2023(3) dt.03-05-2023 2/2 been received and according to which out of six witnesses, four have been examined and only the I.O. and the doctor remain to be examined.

Considering the aforesaid fact as also that specific allegation is against him, this Court for the present is not inclined to extend him privilege of bail, which is accordingly rejected.

The trial court is directed to ensure that the trial is concluded within the next six months.
