2. The petitioner has prayed for bail in connection with Udwant Nagar P.S. Case No. 495 of 2025 registered for the offence punishable under Sections 103(1), 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.
3. The case of the prosecution, in short, is that dead body of the father of the informant was lying in pool of blood and he was dead. The informant believes that Bunty Yadav, Bhola Yadav, Shree Ram Yadav, Prabhat Yadav, Ritesh Yadav, Vikash Yadav and Heera Devi have killed his father.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.20379 of 2026(2) dt.10-04-2026 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that the name of the petitioner does not find place in the FIR. During the course of investigation, coaccused Vikash and Prabhat have given their confessional statement and they have named this petitioner. Save and except confessional statement of co-accused persons, there is nothing against the petitioner. He further submits that similarly situated other co-accused person has been granted bail by this court vide Cr. Misc. No. 4925 of 2026. The case of this petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 14.10.2025.
5. The application for bail is opposed by learned APP for the State and submits that the petitioner has criminal antecedent of two cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwant
