The petitioner seeks bail in a case instituted under Sections 302, 384, 34 of the Indian Penal Code read with Section 27 of the Arms Act.
The prosecution story, in brief, is that the petitioner along with other co-accused reached at the betel shop of the deceased and demanded a ransom to which the he refused. In the meantime, co-accused namely Chandra Shekhar Paswan shot fire upon the deceased, resulting into his death.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.07.2016. The charge sheet has been submitted in the present case. There is no allegation of
Patna High Court Cr.Misc. No.51404 of 2016 (2) dt.06-12-2016 2/2 tampering of witnesses alleged against the petitioner. The petitioner is said to be the order giver. No injury has been caused by the petitioner to the deceased. The main allegation is against co-accused namely Chandra Shekhar Paswan.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Begusarai, in connection with Garhpura P.S.
