Petitioner, who is in custody, seeks bail in connection with Paraiya P.S. Case No. 10 of 2017 registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and under Section 27 of the Arms Act. Informant has alleged in his FIR that his son was killed by four persons as named in the FIR.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has falsely been implicated in this case. There is no specific allegation of firing against any of the accused as named in FIR. They have been implicated in this case due to land dispute.

No.69507 of 2018(2) dt.04-12-2018 2/2 It has been further submitted that similarly placed co-accused Bijali Paswan and Vikash Paswan has been granted bail by coordinate Bench of this Court in Cr. Misc. No. 58071 of 2017 and 23453 of 2018 vide order dated 08.01.2018 and 14.05.2018 respectively.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Shefali Narayan, learned J.M. 1st Class, Gaya in connection with Paraiya P.S. Case No. 10 of 2017.
