The petitioners apprehend their arrest in registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner nos. 1 and 2 assaulted the informant with knife. Petitioner nos. 3, 4 and 5 assaulted him with fist and slaps and petitioner no. 6 assaulted

Patna High Court CR. MISC. No.23343 of 2023(2) dt.26-06-2023 2/2 him with butt of pistol. Petitioner no. 7 snatched silver chain and cash of Rs. 1500/- from possession of the son of informant. It is further alleged that all the accused persons assaulted his son.

It is submitted that petitioners have been falsely implicated in this case. The injury report does not support the prosecution case. As per the injury report, there is only one lacerated wound on the forehead. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bhagalpur in connection with Budhuchak P.S. Case No. 82 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
