JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 47A of the Excise Act. Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that earlier petitioner was granted police bail under Section 41(a) of the Code of Criminal Procedure and now chargesheet has been submitted against him. As such, petitioner has moved before this Court for anticipatory bail. It has also been submitted that there is no criminal antecedent against the petitioner and another coaccused has already been granted anticipatory bail by a Bench of this Court vide Annexure-2 to the present petition. Heard learned A.P.P. also.

P.C. and another co-accused has already been granted anticipatory bail, let above named petitioner, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra, in connection with Ekma P.S. Case no. 176 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned,
