The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 353, 323 and other allied sections of the Indian Penal Code and section 3/4 of the Prevention of Damage to Public Property Act. Prosecution case, in brief, is that on the alleged date and time of occurrence, some unknown miscreants badly damaged the glasses, windows and other parts of the car of informant bearing registration no. BR05H5736.

Allegation is general and omnibus. It is further submitted that this occurrence, led to institution of 13 cases, in which, the petitioner in a mechanical manner went on being implicated. Similarly situated co-accused have been granted bail by a different Bench of this Court vide order dated 14.11.2022 passed in Cr. Misc. No. 26064 of 2022.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sadar, East Champaran, Motihari in connection with Rajepur P.S.
