Shri Dilip Kumar Sinha, APP =========================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL JUDGMENT Date: 07-05-2015 Two developments have taken place ever since the case was adjourned on 16.4.2015. The 1st development is that the Learned Principal Additional Advocate General placed before this Court a copy of the report of Chief Secretary, Bihar dated 2.5.2015. It shows that he enquired into the matter and, prima facie, found that there was serious lapse on part of the City Superintendent of Police, Gaya in relation to Kotwali P.S. Case No.287/12 (pending before the learned C.J.M., Gaya). It is also mentioned that a show cause notice would be issued directing him to explain as to why disciplinary action shall not be initiated. The 2nd development is that the petitioner was arrested on

Patna High Court Cr.Misc. No.31118 of 2013 dt.07-05-2015 2/2 18.4.2015.

Therefore, in view of these developments, criminal miscellaneous petition is closed as infructuous and it is hoped that the steps contemplated in the report of the Chief Secretary would be followed.
