1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the opposite party no.2.
2. The petitioner apprehends his arrest in connection with Complaint Case No.143 of 2024 instituted under Sections 341, 323, 498A, 504, 506/34 of the I.P.C. and Section 3 & 4 of Dowry Prohibition Act.
3. As per the prosecution case, marriage of the opposite party no.2 was solemnized with the petitioner on 18.02.2018 according to Hindu Custom and at the time of marriage her parents have given several articles. It is further alleged that she went to her sasural and living peacefully and
Patna High Court CR. MISC. No.21619 of 2026(3) dt.01-07-2026 2/3 also gave birth to a girl child, after birth of baby, her in-laws started torturing her and demanded Rs.2 lakhs as dowry. It is also alleged that father of opposite party no.2 tried to pacify the matter but lastly on 23.10.2023 they have assaulted and ousted her from her matrimonial house.
4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He further submits that the marriage of opposite party no.2 was solemnized with petitioner on 18.02.2018 and out of their wedlock, one daughter was born. Learned counsel submits that allegation of torture and demand of dowry is general and omnibus in nature. He further submits that petitioner is always ready to keep his wife with dignity and has filed Matrimonial Case No.14 of 2026 under Section a of Hindu Marriage Act for restitution of conjugal rights which is pending in the Court of learned Principal Judge, Family Court, Khagaria. Learned counsel submits that petitioner has got clean antecedent and he undertakes to cooperate in the trial of the case.
5. Learned A.P.P. for the State and learned counsel for the opposite party no.2/informant oppose the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.21619 of 2026(3) dt.01-07-2026 3/3 and submissions of learned counsel for the parties and the nature of allegation against the petitioner as well as his clean antecedent, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned J.M. IInd Class, Naugachia/concerned Court in connection with Complaint Case No.143 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
