JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376, 341, 323, 34 of the Indian Penal Code.

The prosecution case is that petitioner entered into the house of the informant and established forceful physical relationship. The petitioner was caught on the spot by the family members of the informant when family members of the petitioner got him released.

It is submitted by learned counsel for the petitioner that petitioner is agnate of the informant and due to the land dispute the accusation has been levelled. Moreover the informant has retracted from the initial version and has filed a petition to that effect before leaned Court below. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner

Patna High Court Cr.Misc. No.42038 of 2015 (2) dt.13-10-2015 2/2 surrenders within a period of six weeks in connection with Madhepura Mahila P.S. Case No. 22 of 2012, pending in the Court of learned Chief Judicial Magistrate, Madhepura. With the observations above, the application stands disposed off.
