JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-379, 511, 427 of the Indian Penal Code. Petitioners are named in the first information report but according to prosecution case itself, nothing was stolen in the present case.

Submission on behalf of petitioners is that they were caught by the police on mere suspicion and subsequently, they have been roped in this case at the instance of tempo driver with whom, some altercation had taken place on the point of payment of fair of the aforesaid tempo.

No.40370 of 2016 (2) dt.28-09-2016 2/2 No doubt, petitioners do have some criminal antecedent but considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Hajipur Sadar P.S. Case No. 246 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
