In the light of statement made in supplementary affidavit, Counsel for the petitioner is permitted to make necessary correction in paragraph-3 of the main application in course of the day. Heard learned counsel for the petitioner, O.P. No. 2 and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 341, 323, 307, 354, 379, 427, 504, 506/34 of the Indian Penal Code. The prosecution case in brief is that while the informant along with his wife reached at the parking place of the apartment, the petitioner along with others started assaulting the informant and his wife with iron rod, as a result of which, the informant and his wife sustained injuries and his car was also damaged.

No.20270 of 2019(3) dt.24-04-2019 2/2 It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 07-12-2018. The informant is maternal father-in-law of younger step brother of this petitioner. After death of father of the petitioner, the step mother of the petitioner recommended the step brother for the purpose of compassionate appointment. The petitioner filed objection in respect of the appointment of his step brother and for the said reason, multiple litigations were created between the parties and cases were instituted for oblique reason.

On behalf of the State and O.P. No. 2 , it is submitted that the petitioner is named in the Complaint Case/F.I.R. Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Patna in connection with Shastrinagar P.S. Case No. 300 of 2018.
