JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail on behalf of the petitioner, who is an accused in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

Learned counsel for the petitioner, referring to the First Information Report, has submitted that admittedly the said Bolero Jeep was not recovered from the possession of the petitioner and his name cropped up only on the basis of confessional statement of the garage owner that the petitioner had given the said vehicle to him. In view of the submission as above, let the

No.48229 of 2014 (2) dt.23-04-2015 2/2 petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur, in connection with Muzaffarpur Town P.S. Case No. 819 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

Grant of bail, however, is subject to the condition that the petitioner will cooperate in course of investigation with the police and shall present himself before the court below as and when required and in the event of failure on his part in this regard, will lead to cancellation of his bail bonds, furnished by him in the light of the present order.
