JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and the State. The case is under Sections 304(B)/120(B)/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner is Dewar of the deceased and there is no specific allegation against the petitioner either of demand or assault and there is omnibus allegation against the petitioner. Heard learned APP appearing for the State, who could not controvert this fact.

In view of the facts and circumstances stated above, let the petitioner above named in the event of his arrest or surrender in the Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two

Patna High Court Cr.Misc. No.51400 of 2016 (2) dt.14-12-2016 sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Patrakar Nagar P.S. Case No. 214/2016, subject to the conditions laid down under Section 438(2) Cr.P.C.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
