JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 498A, 323, 341, 342, 307 and 34 of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act.
Heard learned counsel for the petitioners.
It has been submitted on behalf of the petitioners that petitioner no. 1 is the father-in-law, petitioner no. 2 is mother-inlaw and petitioner no. 3 is brother-in-law of the informant and there is general and omnibus allegation against the petitioners including 20 to 25 other accused persons of the village. Heard learned A.P.P. also.
Having heard both sides and considering the fact that
Patna High Court Cr.Misc. No.7250 of 2017 (2) dt.22-02-2017 2/2 there is general and omnibus allegation against the petitioners and they are father-in-law , mother-in-law and brother-in-law, let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Danapur at Patna, in connection with Maner P.S. Case no. 331 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. There are other conditions also that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the investigation and make themselves available before the police as and when required.
