The petitioner is languishing in custody since 22.02.2019 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is alleged that on receiving a secret information that the illicit liquor is being sold, a raid was laid, when 30 litres of illicit country made liquor were recovered and one person was apprehended, who disclosed his name as Jai Singh @ Jai Ram, the petitioner.

It is submitted by learned counsel for the petitioner that the recovery has been made from the embankment of the river and the petitioner has been apprehended mere on the basis of suspicion. A statement has been made in paragraph 3 of the

Patna High Court CR. MISC. No.19506 of 2019(2) dt.01-04-2019 2/2 petition that the petitioner is not having any criminal antecedent. Learned APP submits that the petitioner was apprehended from the place of recovery and he is named in the FIR.

Considering the recovery being made from the embankment of the river and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 2030 of 2019, arising out of Maner P.S. Case No. 97 of 2019.
