JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but from perusal of the impugned order, it would appear that the informant named the petitioner when his further statement was recorded. However, petitioner and informant are co-villagers but, even then, at the time of giving written report, the informant did not disclose the name of petitioner as assailant. Petitioner came before this Court for grant of anticipatory bail, which was rejected in the year 2014, directing the petitioner to surrender before the court below within six weeks but petitioner could not surrender before the court below in time. However, petitioner is in jail custody since 19.06.2016 and the investigation against him
Patna High Court Cr.Misc. No.44829 of 2016 (2) dt.18-10-2016 2/2 appears to have already been completed.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Jamui in connection with Session trial no. 192 of 2016 arising out of Jamui P.S.Case No. 419 of 2011.
