2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126(2), 115(2), 69, 352, 351(2), 351(3), 3(5) of BNS.

3. The case of the prosecution is that the informant was in relationship with the petitioner and it is alleged that on the promise of marriage, petitioner started coming to the house of the informant and started establishing physical relationship with her. She was taken to Delhi and was kept there as his wife. It is further alleged that now the petitioner has denied to marry her.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the relationship was consensual one between them and the petitioner has never established physical relationship with her on the false promise of marriage. It has further been submitted that petitioner is still ready to marry the informant which is apparent from the order of the learned trial court as the learned trial court has recorded that learned counsel for the petitioner has submitted that the petitioner has never denied marrying the informant and he is still ready to marry. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 17.09.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. From perusal of the facts and circumstances of this case, it is clear that it is a case of relationship between two adults and break up thereafter, however, the petitioner is still ready to marry the informant.

7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is

The above named petitioner is directed to be released on bail in connection with Araria Mahila P.S. Case No. 40 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-I, Araria.
