JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek anticipatory bail in a case registered for the offences punishable under Sections 498A, 302/201/34 of the Indian Penal Code.

Petitioner no.1 is father-in-law. Petitioner no.2 is the elder brother of the husband and petitioner no.3 is wife of petitioner no.1. The marriage between the deceased and son of petitioner no.1 was admittedly solemnized nearly 12-13 years prior to the date of occurrence.

Learned counsel for the petitioners submits that nothing

Patna High Court Cr.Misc. No.48156 of 2014 (2) dt.23-04-2015 has been alleged in the First Information Report on the basis of which an offence under Section 302 of the Indian Penal Code is said to be made out against the petitioners. He appears to be right in his submission.

This anticipatory bail application is accordingly, allowed. Let petitioners above named in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabua in Bhagwanpur (Belaon) P.S. Case No. 108 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
