JUSTICE SUDHIR SINGH ORAL ORDER 23-04-2015 The petitioner is apprehending his arrest in connection with Karpi P.S.Case No. 170 of 2014 for the offence under Sections 420, 406, 409 and 34 of the Indian Penal Code. Heard learned counsel for the petitioner and the State. The prosecution case, in brief, is that the informant is the Block Development Officer, who on the direction of the District Magistrate, Arwal, has alleged that the petitioner being Ex- Mukhiya of Karpi Gram Panchayat besides other accused persons have withdrawn government money of Rs. 57,500/- under B.R.G.F. Scheme in the name of fixing of 10 hand pump for the locality and the records of the relevant register of the scheme has not been handed over by the then Panchayat Secretary. It has been submitted on behalf of the petitioner that

On behalf of the State, it has been submitted that there is specific allegation against the petitioner for making defalcation of Rs. 57,500/-.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri B.M. Tripahi, Judicial Magistrate, 1st Class, Jehanabad in connection with Karpi P.S.Case No. 170 of 2014 , subject to the conditions as laid down u/s 438(2) Cr.P.C. The petitioner is further directed to deposit an amount of Rs. 25,000/- (twenty five thousand) in the court below, which will be subject to the final result of the case.
