JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-08-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 15.07.2016 in a case registered for the offences punishable under Sections 290 of the IPC and 20 and 23 of the NDPS Act.

On information that two persons are consuming ganja in RPF ground, the raid was laid when petitioner Mahesh Kumar Rai and one Himanshu Prasad were apprehended. From the pocket of the petitioner, 25 grams of ganja were recovered. It is submitted by the learned counsel for the petitioner that recovery is of small quantity. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Mr. J.N. Thakur, learned counsel for the State does not

Patna High Court Cr.Misc. No.37312 of 2016 (2) dt.30-08-2016 2/2 dispute the quantity of recovery.

Considering the small quantity of recovery and statement made in para 3 of the petition that the petitioner has no criminal antecedent let the above named petitioner, be released on bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Munger in connection with East Colony P.S. Case No. 36 of 2016.
