2. Heard the parties.

3. Learned counsel appearing on behalf of the petitioner has contended that persons having lesser merit position has been selected and appointed ignoring higher merit position of the petitioner.

4. The contention of the petitioner is disputed by the respondents. In the counter affidavit, it has been stated by the respondents that in non-homeguard B.C. (male) category, the cut off marks is 284 whereas the petitioner has secured 282.67 marks.

5. In the aforesaid circumstance, this Court does not find justify to grant any indulgence to the petitioner. However, liberty shall be available to the petitioner to file appropriate representation along with a copy of this order before the appropriate authority citing example of appointment of candidates having lesser marks then the petitioner in non-homeguard B.C (male) category and on showing such anomaly, the respondents will consider the case of the petitioner and pass appropriate order on his representation. The entire exercise in this regard may be completed by the respondents within a period of four months from the date of receipt/production of a copy of this order.
