The Petitioner seeks quashing of the order dated 15.4.2013 by which the Sessions Judge, Munger, in Criminal Revision No. 95 of 2013 set aside the order of cognizance dated 28.1.2013 taken by the Chief Judicial Magistrate, Munger, in Complaint Case No. 754C of 2012 in his absence. Now that the Opposite Party No. 2 has appeared, it would be desirable that the Magistrate be directed to pass an order of cognizance within a period of three weeks from the date of receipt of this order without being prejudiced by any observation of the Petitioner.
