JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-05-2019 The petitioners have a grievance that they had represented the Department for settlement of Government land on lease for cultivation under certain scheme of the State Government. The said scheme is not there on record. The petitioners' case was referred to the Circle Officer. It also appears that the petitioners have approached the Circle Officer, Kahra, Saharsa, for settlement of land on lease under the said scheme of the State Government. The last representation, which the petitioners claim to have filed, is of 24.06.2016. I do not intend to go into the correctness of the claim,

Patna High Court CWJC No.9177 of 2019(3) dt.06-05-2019 2/2 which the petitioners have made in the application, inasmuch as even the scheme of the State Government, under which the petitioners are raising their grievance, has not been shown to this Court. The Court, however, would expect the Circle Officer to consider the petitioners' case and take appropriate decision within three months from the date of receipt/production of a copy of this order. It is made clear that if any Government land is to be settled for agricultural purpose or any other purpose, the same will have to be done in accordance with law, even under the scheme, by giving similarly situated persons an opportunity to apply for such settlement.

The writ application stands disposed of.
