The Petitioner seeks quashing of the order dated 15.6.2013 by which the 3rd Additional Sessions Judge, Hilsa (Nalanda) has refused to summon the Opposite Party No. 2 to face trial in Sessions Trial No. 479 of 2012.
The case diary was gone into and it was found that none of the witnesses named him in the statements recorded under Section 161 Cr. P.C. In such circumstances, the order refusing to summon of the Opposite Party No. 2 to face trial is evidently justified. The application stands dismissed.
