The petitioners apprehend their arrest in Kuchila P.S. Case No. 18/2015, registered for the offences punishable under Section 436 and other sections of the Indian Penal Code. The informant made allegation that petitioners along with other accused persons came armed with lathi and danda abused and put fire in his hut.
The informant made omnibus and general allegation against the petitioners and other accused persons. It is submitted that prior to this case, Pramod Lal,
Patna High Court Cr.Misc. No.40767 of 2015 (2) dt.05-10-2015 2/2 petitioner no. 2 filed a case bearing no. 23/2014-15 before the Deputy Collector Land Reforms, Sasaram. There is a land dispute for the way on Sarvasadharan plot no. 321 which is gair mazarua. The informant admitted in his written statement that he encroached the land and an order was passed in this regard on 13.08.2014. Thereafter, the present case is lodged on 02.06.2015. Considering the facts aforesaid, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Bhabhua in connection with Kuchila P.S. Case No. 18/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
