Petitioner is apprehending arrest in connection with Muffasil P.S. Case No. 11 of 2019 for the offence under sections 341, 323, 308/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that the petitioner and the informant are own brothers and scuffle took place on account of irrigating the flower plant. Learned counsel submits that parties have entered into a compromise and he referred to Annexure-2 in this regard. Considering the fact that the petitioner has no criminal antecedent and the informant and the petitioner are own brother

Patna High Court CR. MISC. No.25884 of 2020(2) dt.14-10-2020 2/2 and they have entered into a compromise as evident from Annexure-2, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of communication of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Muffasil P.S. Case No. 11 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C.
