The petitioner apprehends his arrest in Sikandra P.S. Case No. 25/2014, registered for the offences punishable under Section 409 and other Sections of the Indian Penal Code. The petitioner is the Secretary of Bhullo PACS. The Secretary and the Chairman of the PACS are alleged to have misappropriated the amounts of Kharif crops insurance of farmers. It is submitted that the allegation is of the financial year 2009 - 2010. The complaint petition is filed in the year 2013. The petitioner did not defalcate any money. The farmers received their insurance money from the Co-operative Bank and not from the petitioner. Similarly situated co-accused Anand Mahto @ Anand Mohan, the Chairman of the PACS has already been granted anticipatory bail vide order passed in Cr. Misc. No.
Patna High Court Cr.Misc. No.41733 of 2015 (3) dt.17-12-2015 21181/2015.
Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Sikandra P.S. Case No. 25/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
