====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-12-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Bihra P.S. Case No. 167 of 2018 for the offence punishable under Sections 147, 148, 149, 341, 323, 379 and 385 of the Indian Penal Code and 27 of the Arms Act.
Learned counsel appearing for the petitioners submits that the petitioners are innocent and have not committed any office. In fact, the F.I.R. has been lodged after lapse of 10 days from the date of occurrence which creates
Patna High Court Cr.Misc. No.69451 of 2018(2) dt.18-12-2018 2/2 doubt over the prosecution version. The petitioners have falsely been implicated in this case on account of land dispute and no specific case is made out against them. Hence, the petitioners may be granted the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the, above named, petitioners in the event of surrender before the court below within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bihra P.S. Case No. 167 of 2018 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
