Allegation in brief is that the petitioner kidnapped the minor daughter of the informant.

Submission is that the girl in her statement recorded under Section 164 Cr.P.C. has not alleged any sexual exploitation of her. In fact, both are major and were in love relationship. The medical report also assessed her age above 17 years but below 19 years and this petitioner has been in custody since 25.1.2016. Having considered the entire facts and circumstances, the girl appears on the verge of majority so the petitioner, namely, Tridev Kumar Paswan @ Tridev Paswan is directed to be released
