The petitioners apprehend their arrest in connection with Gopalpur P. S. Case No. 224 of 2016 instituted under Sections 341, 323, 308, 504 and 379/34 of the Indian Penal Code. Allegation against these petitioners is that they assaulted the son of the informant with the butt of the pistol on the head.

It is submitted by learned counsel for the petitioners that there is case and counter case between both the sides and the case from the petitioners' side was lodged on the same day. It is submitted that as per allegation, these two petitioners caused injury to the son of the informant by butt of the pistol, which is

Patna High Court Cr.Misc. No.5680 of 2017 (2) dt.07-02-2017 2/2 hard blunt substance and the corresponding injury is by sharp cutting weapon and the petitioners have got no criminal antecedent.

Having found the corresponding injury grievous in nature over the head, which is specific against the petitioners, hence, the prayer for anticipatory bail of the petitioners is rejected. However, the petitioners, if so advised, surrender before the court below and pray for regular bail, which shall be considered without being prejudiced by this order, preferably on the same day, if the injury reports are available.
