The petitioner apprehends his arrest in Islampur P.S. case No. 41 of 2019 registered under Section 30(a) of the Bihar Prohibition & Excise Act.
The learned counsel for the petitioner submits that small quantity of liquor is said to have been recovered from the room of petitioner. The petitioner has got no criminal antecedent.
Considering the fact that two liters of country made liquor is said to have been recovered from the bedroom of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. If the petitioner surrenders in the court below, that is, learned Additional Sessions Judge-III, Biharsharif, Nalanda in
Patna High Court CR. MISC. No.19905 of 2019(2) dt.01-04-2019 2/2 Islampur P.S. case No. 41 of 2019, the learned court below shall consider the prayer for regular bail of the petitioner taking into consideration the fact that small quantity of liquor is said to have been recovered and dispose of the bail petition as early as possible.
