The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302 and 120(B)/34 of the Indian Penal Code.
When the dead body of Lankesh Kumar, the son of the informant was found on the railway track, initially, the F.I.R. was lodged by the railway authority against unknown. After five months the informant filed the present case with allegation that to grab the money of the deceased the petitioner and others have committed the murder and put the dead body on railway track to show it as accident.
Submission is that co-accused, namely, Rajesh Kumar having similar allegation has already been granted
Patna High Court Cr.Misc. No.52000 of 2016 (2) dt.20-12-2016 2/2 anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 33267 of 2016 and allegation against the petitioner is of similar footing.
Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura/Successor Court in connection with Murliganj Police Station Case No. 113 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
