The petitioner as a Panchayat Teacher posted in the Primary School, Piprahi, under block Vijaipur, in the district of Gopalganj, was not serving the institution and remained allegedly absent perennially and her signature in the attendance register was being incorporated by someone else. The Collector ordered an enquiry and the same was conducted by the DCLR and the Block Education Extension Officer of Vijaipur Block who reported the allegations true. It was how the FIR was lodged. The contention was that the signatures were being made by one Bhuttur Rai. The Court is of the view that the petitioner being the chief beneficiary of the fraud and forgery must not escape the criminal liability
