JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 447, 427, 341, 323, 307, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioners is of assaulting the informant due to land dispute and petitioners are named in the F.I.R.

Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that there is no specific allegation against the petitioners. They are only members of the mob and are neighbours of the informant. Petitioners have falsely been implicated in the present case. Heard learned A.P.P. also.

No.16766 of 2017 (2) dt.17-04-2017 2/2 Having heard both sides, in view of the fact that there is no specific allegation against the petitioners and they are only members of the mob, let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Samho P.S. Case no. 21 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the investigation and make themselves available before the police as and when required.
