JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-06-2020 Heard Mr. Malay Kumar Chaudhary, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Ahiyapur P. S. Case No. 1379 of 2019 dated 20.11.2019 instituted for offences under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act, 1959.

On secret information to the police that some miscreants are standing near NH 57 for the purposes of committing some crime, a raid was conducted. Five persons were arrested with firearms. From the possession of the petitioner, one country-made pistol and one live cartridge were seized.

It has also been urged that he was picked up from his house and because of his antecedents, he has been shown to be an accused in this case.

Some of the other accused persons of this case, being similarly situated, have been granted bail by different Benches of this Court.

The petitioner is in custody since 20.11.2019. Considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P. S. Case No. 1379 of 2019.

The petition stands allowed.
