JUSTICE RAVI RANJAN ORAL ORDER 19-09-2017 Learned counsel for the petitioners seeks leave to withdraw this application so far it concerns the petitioner no.3, Lalu Rai @ Pramod Rai to surrender and seek regular bail. Accordingly, this application stands dismissed as withdrawn so far the petitioner no.3 is concerned with the aforesaid liberty granted to him.

I have heard learned counsel for the petitioner and the State.

The petitioner nos.1 and 2 apprehend their arrest in a case registered for offences punishable under Section 302, 201, 120B/34 of the Indian Penal Code.

As per allegation, son of the deceased went to in-laws house where he was killed and his dead-body was disposed.

No.19479 of 2017(4) dt.19-09-2017 2/2 However, it is contended that it is apparent from the allegation itself that when the informant reached at the house of in-laws of his deceased son, the mother and his widow wife were present but no male person was there. Be that as it may, since learned counsel for the State has not been able to show from the case diary that there is any direct evidence against the petitioner nos.1 and 2, save and except the aforesaid allegation and the fact that both petitioners are ladies, let the petitioner nos.1 and 2, i.e., Angan Devi and Urmila Devi be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Sakra P.S. Case No. 364/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.-cum-Sub-Judge, 13th, Muzaffarpur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
