Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-10-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is apprehending arrest in connection with Rampur P.S. Case No. 373 of 2019 for the offence under sections 341, 323, 325, 307, 379, 506, 34 of the Indian Penal Code 20,20 N.D.P.S. Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He refers the previous case lodged by sister and father of the informant in which the petitioner has been made accused.

Learned counsel further submits that injury report is manipulated one as evident from Annexure-2 itself as medical report from a private doctor is not based on the examination of the injury but the report was based on assessment of 10 days old

Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioner subject to the condition that the petitioner shall deposit Rs. 25000/- cash in the court below and on deposing of Rs. 25000/- the court below shall release the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of communication of this order on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Rampur P.S. Case No. 373 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. The amount of Rs. 25000/- cash deposited by the petitioner shall abide by final outcome of the pending criminal case.
