01-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Harsidhi P.S. Case No. 497 of 2020, registered for the offence under Section 302, 34 of the Indian Penal Code.

As per the F.I.R., the son of the informant was married with petitioner and it is further alleged that this petitioner had illicit relation with another person, which was opposed by the deceased (husband of petitioner), as a result of which, all the family members of petitioner including petitioner, conspiring with each other, committed the murder of son of informant and threw his dead-body.

It is submitted on behalf of petitioner that petitioner is wife of the deceased. Save and except suspicion, there is no other material so show complicity of petitioner in the aforesaid

Patna High Court CR. MISC. No.30639 of 2021(3) dt.01-12-2021 2/2 crime. Informant is not the eye-witness. Petitioner, who is lady, is in custody since 22.12.2020. Investigation is complete. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari in connection with Harsidhi P.S.
