The petitioner apprehends his arrest in Barachatti P.S. Case No. 14/2017, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The informant alleged that petitioner Lila Yadav, Sohri Devi, Munki Devi came and abused her. They assaulted her with stick causing bleeding injury on her head. Lila Yadav (petitioner) torn her blouse.
Learned counsel for the petitioner submits that the petitioner was married with Sohri Devi. Sohri Devi is the cosharer of the Kharagdhari Yadav husband of the informant. There was a Panchayati and the Panches decided vide annexure-3 to earmark the room for ingress and egress of the informant and the
Patna High Court Cr.Misc. No.16324 of 2017 (2) dt.09-05-2017 2/2 petitioner. On account of land dispute, this false case has been lodged. The injuries found on the person of the informant are simple in nature.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Barachatti P.S. Case No. 14/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
