2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 420 and 120 ( b ) of the Indian Penal Code.

3. As per the prosecution case, complainant namely Seema Tiwari alleged that she approached the petitioner Ravi Raj for purchase of land who sold her Government land. It is further alleged that this petitioner sold a government land to complainant and took Rs. 16,40,000/- from complainant.

4. Learned counsel for the petitioner submits that

No.26214 of 2025(3) dt.07-07-2025 2/3 from bare perusal of complaint petition, it is apparent that petitioner has executed an agreement (Bai Baina) with complainant on 06.09.2011 for purchase of a piece of land measuring an area of 1 katha, 13 Dhur, 6.5 Dhurki, bearing Plot No. 156, Khata No. - 42 situated at Phulwari Sharif Police Station No. 40. After execution of aforementioned agreement, petitioner requested compliant to register the land in her name but she refused to purchase the land and told the petitioner that she wanted to purchase another land at some other place and further requested petitioner to return the aforementioned amount of Rs. 13,40,000/- and accordingly petitioner returned the cash to complainant.

It is further submitted that since 2011 to 2022, complainant never made any complaint against petitioner either for litigation or for money or for execution of sale deed but after lapse of more than 10 years this false and fabricated complaint has been lodged against this petitioner. Moreover the dispute is purely civil in nature for which the complainant has got remedy in the Court below .

5 . Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the fact that dispute involved in this case is purely civil in nature and circumstances of the case , in

No.26214 of 2025(3) dt.07-07-2025 3/3 the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class Patna Sadar Patna in connection with Complaint case No. 5571 of 2022 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
